PRESENT DAY 67 - Charge Trump with Treason Now
On the day before Independence Day, let’s review what the Constitution actually says about treason:
Article III, Section 3, Clause 1: Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the testimony of two Witnesses to the same overt Act, or on Confession in open Court.
Now let’s see how many times and ways Trump violated this article of the Constitution. Did Trump “levy war” against the United States? We all watched him do it on Jan. 6, 2021 on live t.v. “Go to the Capitol; fight like hell or you won’t have a country,” Trump told an armed mob of thousands of MAGA zombies and that’s exactly what they did. Trump would have been there leading them into the Capitol had he not been physically restrained by his Secret Service team in the car according to the only believable witness we’ve heard on this subject so far, Cassidy Hutchinson. This was likely an illegal act on their part because the president is the commander-in-chief and a violation of his orders is a violation of the law and their oaths. But they had just watched Trump incite a violent, armed mob to attack the Capitol. They knew as well that Trump’s presence leading the mob would have instigated even more violence against members of Congress and the vice president. So against Trump's wishes and orders they drove him back to the White House. Remember that these same Secret Service agents either lied to the J6 committee or refused to talk to them altogether. It’s likely that Trump had only MAGA zombie agents around him and yet he still physically attempted to turn the car to the Capitol. If sending an armed mob with trained, organized military components to it to the Capitol and then surveying the battle from a vantage point as military leaders often do - in Trump’s case from the complete safety of the White House - is not “waging war,” then nothing is. Is there evidence of Trump “adhering to [the United States’] enemies?” We need only to look at a couple of Trump tweets to know that he did indeed violate this part of Article III, Section 3, Clause 1. As NPR reported, “'Big protest in D.C. on January 6th,’" [Trump] wrote, referring to the day Congress was set to formally certify Joe Biden's victory in the electoral college. ‘Be there, will be wild!’” If this isn’t “adhering” to the enemies attacking the Capitol, nothing is. After watching the attack for more than three hours, Trump eventually sent out a video calling those attempting to overthrow his own government, the same mob he sent to do just that, “very special” people. If this isn’t “adhering to [our] enemies,” then nothing is. Has Trump given “aid and comfort” to the mob he sent to stop the transfer of power from himself to the duly elected Joe Biden? We need only look to recent public pronouncements where Trump vows to pardon these traitors. Trump, of course, calls them “patriots,” which alone ought to prove what they really are, given that Trump consistently turns the truth upside down. Not only did Trump give aid and support on J6, he continues to do it and do it publicly to this day. We need not add in Trump’s overseeing of the treasonous plan for Mike Pence to count fake electoral votes in order to prevent the transfer of power, though we certainly could. All of the above violations of Article III, Section 3, Clause 1 can be applied to that scheme as well. Are there “two Witnesses” to testify to Trump’s violations of this article of the Constitution? Millions watched it on t.v. Dozens, if not hundreds, are directly involved with fake electoral college scheme. Then we’ve got all the testimony gathered by the J6 committee under oath testifying to Trump’s violation of this article of the Constitution, which is why fascist Trump Republicans are doing everything they can to discredit that committee and it’s work. Trump is even calling for Luz Cheney’s execution. Cheney, of course, was a prime mover on that committee and so we’ve got yet another example of the traitor Trump projecting his own treason onto those who have called him out for his actual treason. And let’s not forget the 150 or more cops who were violently assaulted by the Trump mob that day. In other words, there is no shortage of witnesses to Trump’s violation of the Constitution. The only question remaining is why Trump has yet to be charged with treason, a crime for which he cannot be protected by his corrupt “Supreme” Court without their simply admitting that the Constitution has nothing to do with their “decisions.” The answer seems to be that Merrick Garland is too timid to charge Trump with the one crime that we all watched him commit with our own eyes and for which there is no legal remedy because it is a direct violation of the Constitution. Maybe Garland doesn’t like the idea of charing a former president with a capital offense because, as we saw in the Lincoln case, traitors have been executed in American history. There is precedent.

And it didn’t take years for justice to arrive in 1865. It took about three months. Booth, of course, was simply shot on the run a few days after the assassination. In the wake of the Trump “supreme” court’s obviously unconstitutional decision to grant Trump immunity, Trump has been calling for the execution of anyone he doesn’t like. Liz Cheney isn’t the only one Trump wants to eliminate Putin style. Clearly Trump sees his court’s decision to grant him immunity as carte blanche for all of the crimes and murders he intends to commit (on Fifth Ave. and elsewhere) and that’s exactly what it is. It’s a commit crimes with impunity card and that’s precisely what this “supreme” court meant it to be.

So it’s time to charge a real traitor with the treason he committed out in the open on Jan. 6, 2021. It wasn’t the only treasonous act committed by Trump during his four year crime spree but it was the most obvious and possibly the most egregious, if you can even sort treasonous acts into more or less egregious. So far the justice system has failed us and the country. As long as Trump has not been sentenced and jailed for the crimes he committed, the justice system is a failure. Juan Merchan contributed to that utter failure yesterday by postponing Trump’s sentencing in the fraud case for which Trump has already been found guilty on 34 felony counts by a jury of his peers until at least some time in September. Apparently, like Garland, Merchan is afraid to treat Trump as the criminal that he is. Whether that’s because of the physical intimidation inherent in holding Trump accountable or even in just speaking the truth about him, I don’t know. We’ve seen Trump’s appeals to his disciples for violence yield exactly that and so we know Trump’s calls to violence are not idle threats. It worked on J6 on a large scale but we’ve also witnessed it in the case of the nearly fatal attack on Nancy Pelosi’s husband as well as in other cases. There will be more but that is simply all the more reason to hold Trump accountable now to the law. It will take courage on the part of everyone in law enforcement and within the justice system, including prosecutors, jurors and witnesses, but it must be done. Trump committed treason. He must be held accountable for that. Now.
